Lens.com's Antitrust Suit Against 1-800 Contacts Dismissed

Law360, New York (March 3, 2014, 8:13 PM EST) -- A Utah federal judge on Monday tossed Lens.com Inc.’s antitrust suit accusing rival contact-lens seller 1-800 Contacts Inc. of filing dubious trademark infringement claims, ruling that 1-800 Contacts’ suit could not be a sham because it had a factual basis. 

U.S. District Judge David Sam dismissed Lens.com’s suit with prejudice, following the Tenth Circuit’s decision last year in a related case that 1-800 Contacts’ trademark claims were not baseless.
