Sierra Club Sues EPA Chief Over State Air Quality Plans

Law360, Los Angeles (March 3, 2014, 10:33 PM EST) -- The Sierra Club told a California federal judge on Monday that the head of the U.S. Environmental Protection Agency is violating the Clean Air Act by not taking action amid states' alleged failure to comply with federal air quality regulations.

Seeking injunctive relief, the environmental group wants a judge to force EPA Administrator Gina McCarthy to issue so-called "findings of failure to submit" after California, Ohio, Wisconsin and other states missed a year-and-a-half-old deadline to update their particulate fine matter emission programs.
