Workers Win High Court's First SOX Whistleblower Case

Law360, New York (March 4, 2014, 12:59 PM EST) -- The Sarbanes-Oxley Act's whistleblower protections cover contractors and subcontractors of publicly traded companies, the U.S. Supreme Court ruled Tuesday, taking a broad view of the 2002 statute's anti-relation provisions and reviving two former employees' claims against Fidelity Investments in the high court's first-ever SOX whistleblower case.  

The high court split 6-3 on the key question in the case, concluding that SOX's whistleblower protection clause extends to employees of private contractors who work for public companies, and rejecting Fidelity's argument that SOX banned retaliation only against employees...
