County Investigator's Bias Suit Revived In NJ Appeal

Law360, New York (March 5, 2014, 6:11 PM EST) -- A New Jersey appellate panel on Thursday revived a lawsuit brought by an investigator for the Bergen County Prosecutor's Office who claims she was subjected to workplace discrimination because she is Asian-American, saying her request for reconsideration was not adequately reviewed.

The three-judge panel said that the Law Division judge who had dismissed Lucia Kui’s complaint denied her motion to reconsider the case when she presented new evidence, which she said was previously unavailable, without articulating specific findings of fact or conclusions of law.
