Justices Told Pom Juice Spat Shouldn't Affect Drug Labels

Law360, New York (March 6, 2014, 8:37 PM EST) -- The U.S. Supreme Court should make clear that any of its findings in Pom Wonderful LLC’s juice labeling dispute with The Coca-Cola Co. will affect only food-labeling regulations under the Food, Drug and Cosmetic Act and not pharmaceutical labeling, the Generic Pharmaceutical Association said Monday.

Even though Pom itself has made arguments that relate to the food-labeling aspect of the FDCA, the Supreme Court should clarify that distinction and ensure that its findings do not alter the weight of the U.S. Food and Drug Administration’s approvals...
