NY Court Reopens Asbestos Reinsurance Arbitration Row

Law360, New York (March 11, 2014, 5:50 PM EDT) -- A New York appeals court ruled Tuesday that a court, not an arbitrator, should decide whether Continental Insurance Co. acted too late when it demanded that a group of reinsurers arbitrate a fight over payments for asbestos claims.

The appeals court found that the trial court erred when it rejected the reinsurers' petition to stay arbitration of their dispute with Continental.
