Eye Doc Pays $1.4M, Gets 20-Year Exile In FCA Case

Law360, New York (March 14, 2014, 4:33 PM EDT) -- A Maryland eye doctor will hand over $1.4 million and agree to a voluntary 20-year exclusion from Medicare and Medicaid in order to settle a False Claims Act suit alleging he performed scores of unnecessary surgeries and billed them to the federal government, prosecutors said Thursday.

John A. Kiely, who did not admit wrongdoing, was accused of failing to justify numerous operations he performed at a Baltimore clinic owned by Bon Secours Hospital, and he faced a jury trial that was expected to commence Monday....
