6th Circ. Shuts Down Gospel Star's Fraud Appeal

Law360, Washington (March 17, 2014, 6:44 PM EDT) -- The Sixth Circuit on Monday refused to overturn a $4.8 million restitution order against a member of the legendary Winans gospel music family for scamming investors into purchasing bogus Saudi Arabian oil bonds, saying Winans already waived his right to appeal.

Although Michael Winans Jr. claimed his plea agreement didn't waive his rights to appeal the restitution portion of his wire fraud sentence, three Sixth Circuit judges unanimously shut him down because the agreement and court transcripts contradicted him.
