Sanofi Hit With $20M Suit Over Osteoarthritis Cream

Law360, Los Angeles (March 17, 2014, 6:08 PM EDT) -- Elorac Inc. hit Sanofi-Aventis Canada Inc. with a $20 million breach of contract lawsuit in Illinois federal court on Monday, accusing Sanofi of failing to successfully commercialize a Civamide topical cream used to treat osteoarthritis, despite an obligation to do so in good faith.

According to the suit, Sanofi agreed to use reasonable efforts to develop, market, promote and sell the Civamide cream in accordance with a license agreement. Sanofi instead, in bad faith, has chosen to do nothing to market the product and instead pass off the duties to another party, Elorac alleges.
