Texas Appeals Court Nixes Attys' Fees In Employment Fight

Law360, Los Angeles (March 17, 2014, 7:50 PM EDT) -- A Texas appeals court ruled Friday that Medical Carbon Research Institute Inc. and its owner aren't owed $133,000 in attorneys' fees in breach-of-contract litigation with a former employee because a related settlement blocked such recoveries.

The appeals court reversed a trial court's award of attorneys' fees in the long-running dispute over an allegedly unfulfilled deferred compensation package, and ruled that MCRI and On-X Life Technologies should take nothing on their counterclaim that the plaintiff breached a related settlement agreement.
