Teva Sued For Seeking Approval For Generic Abilify

Law360, New York (April 2, 2008, 12:00 AM EDT) -- Japanese drugmaker Otsuka Pharmaceutical Co. Ltd. has filed a patent infringement suit against Teva Pharmaceuticals USA Inc. and its Israeli parent company Teva Pharmaceutical Industries Ltd. over the anti-psychotic drug Abilify.

Tokyo-based Otsuka filed the suit Monday in the U.S. District Court for the District of New Jersey, claiming that Teva USA's attempt to seek U.S. Food and Drug Administration approval for a generic version of the drug infringed two of the company's patents.
