Fla. Appeals Court OKs Narrow Juror Interview In Engle Case

Law360, Miami (March 19, 2014, 1:41 PM EDT) -- A Florida appeals court Wednesday affirmed the decision of a court to interview the foreperson of a jury who awarded $11.65 million to a former smoker suing Philip Morris USA Inc. after the foreperson voiced concerns about a text received from another juror.

Florida's Fourth District Court of Appeal said the trial court did not err in ordering an in-camera inspection of the text message at issue by the trial judge, who would also ask questions of the foreperson regarding the message's content.
