9th Circ. Says PAC Can Get Attys' Fees In Election Law Row

Law360, Los Angeles (March 19, 2014, 6:55 PM EDT) -- The Ninth Circuit ruled Wednesday that a political action committee opposing rights for same-sex couples could collect $149,000 in attorneys' fees after partially succeeding in its claims that provisions of Washington state election law broke free speech laws as applied to ballot measure committees.

The appeals judges said the term “costs” in the Federal Rules of Appellate Procedure didn't include attorneys' fees, and thus a Washington federal court had properly decided that the Ninth Circuit's previous direction for each party to bear its own costs of...
