NJ High Court To Hear Atty Fee Question In Coverage Row

Law360, New York (March 21, 2014, 5:58 PM EDT) -- The New Jersey Supreme Court is poised to give further guidance on when plaintiffs are entitled to attorneys' fees as successful claimants in insurance litigation, according to an order posted Friday.

The high court granted certification to a warehouse owner, Robert Occhifinto, who sued numerous parties, including Robert S. Keppler Mason Contractors LLC, over an allegedly botched addition, but the justices will focus on the interplay of that litigation with a related insurance suit in which Occhifinto preserved coverage for the contractor through trial.
