Pfizer Beats FCA Suit Over Pain Patch Marketing

Law360, New York (March 21, 2014, 4:35 PM EDT) -- A Maryland federal judge on Friday dismissed a False Claims Act suit accusing Pfizer Inc. and three subsidiaries of misbranding the Flector painkiller patch and paying kickbacks to doctors for prescriptions, finding the employee whistleblower suit failed to establish that any false claims were made.

U.S. District Judge Ellen Lipton Hollander said the allegations in relator Jerome Palmieri’s amended complaint still fell short of alleging that an actual false claim for reimbursement had been submitted to the government.
