NJ Can't Scrap Cap-And-Trade Program Without Rulemaking

Law360, New York (March 25, 2014, 5:27 PM EDT) -- New Jersey Gov. Chris Christie's administration ran afoul of state law by refusing to repeal or amend cap-and-trade program regulations from the state's onetime participation in a regional greenhouse-gas reduction pact, a state appeals court ruled Tuesday.

It wasn't enough that the New Jersey Department of Environmental Protection posted a notice on its website telling power plants that it would no longer implement the regulations based on the state's withdrawal from the Regional Greenhouse Gas Initiative at the beginning of 2012, according to the Appellate Division....
