Law360, Washington (March 24, 2014, 4:41 PM EDT) -- The U.S. Supreme Court declined Monday to consider whether the Eleventh Circuit had wrongly affirmed the dismissal of a consolidated Employee Retirement Income Securities Act suit alleging Aetna Inc., UnitedHealth Group Inc. and others wrongfully denied claims of procedures called “manipulations under anesthesia.”
In an order list, the Supreme Court denied the petition in Sanctuary Surgical Centre Inc. et al. v. Aetna Health Inc. et al., affirming an Eleventh Circuit finding that the plaintiffs in the consolidated suit had failed to state a claim.
