Uniloc's Sparsely Pled Patent Suit Gets Over Hump In Texas

Law360, New York (March 25, 2014, 4:51 PM EDT) -- Just two weeks after a Virginia federal judge argued that patent complaints should be subject to heightened pleading standards, a Texas federal court refused to nix a minimally pled patent infringement suit against Pervasive Software Inc., ruling Friday that the complaint met the necessary factual requirements.

In denying Pervasive’s motion to dismiss Uniloc USA Inc.'s suit over a software registration patent, U.S. District Judge Leonard Davis ruled that Uniloc’s complaint had fulfilled the required elements of Form 18 under the Federal Rules of Civil Procedure....
