10th Circ. Lets Kansas Block Planned Parenthood Funds

Law360, Los Angeles (March 25, 2014, 7:57 PM EDT) -- The Tenth Circuit on Tuesday ruled that Kansas could enforce a law blocking federal family planning funds for two Planned Parenthood clinics while the organization pursues a constitutional challenge of the law, saying the organization hadn't shown it would likely prevail.

In a 2-1 decision, a three-judge panel overturned U.S. District Judge J. Thomas Marten's 2011 ruling blocking enforcement of the state law until Planned Parenthood's lawsuit had run its course. The organization claims that Kansas' law violates the federal law governing the funds, Title X. ...
