9th Circ. Won't Hear Alaska Air Whistleblower Suit

Law360, New York (April 10, 2008, 12:00 AM EDT) -- A federal appellate court asked the California Supreme Court on Thursday to decide whether a lawsuit against Alaska Airlines Inc. by a whistleblower over alleged retaliation is precluded by an administrative order from the secretary of labor.

Kevin Murray, a quality assurance auditor for Alaska Airlines, reported what he believed were safety violations by his employer to the Federal Aviation Administration. Soon after that, the company outsourced several positions, including his, and did not rehire him.
