Federal Circuit Deals Blow To Alpha Scientific

Law360 (April 16, 2008, 12:00 AM EDT) -- The U.S. Court of Appeals for the Federal Circuit has sided with Helena Laboratories Corp. in a patent dispute with Alpha Scientific Corp. over blood collection tubes.

The appeals court decided Wednesday to uphold a lower court's ruling in the case, which involves Helena's H-Pette 3611 device.

Helena filed the lawsuit against Alpha Laboratories in January 2006, seeking a judgment of noninfringement and invalidity of one of Alpha's patents. Alpha later countersued Helena for infringement.
