Agis Can’t Shed Patent Suit Over Scalp Treatment

Law360, New York (April 16, 2008, 12:00 AM EDT) -- Agis Industries Ltd. has failed to brush off claims brought by Connetics Corp. that the Israeli pharmaceutical company’s abbreviated new drug application for a generic of Connetics’ popular scalp treatment Olux infringed its patent.

Agis had contended that its generic product would not infringe Connetics’ patent literally or under the doctrine of equivalents, but Judge Garrett E. Brown Jr. of the U.S. District Court for the District of New Jersey on Monday refused to grant the defendant’s motion for summary judgment of noninfringement.
