Appellate Court Upholds FERC's Entergy Cost Scheme

Law360, New York (April 17, 2008, 12:00 AM EDT) -- A federal appellate court has upheld a majority of rulings made by the U.S. Federal Energy Regulatory Commission outlining rate structures to equalize payments made by customers in the four states that receive electricity from Entergy Corp.

In a ruling issued Tuesday, the U.S. Court of Appeals for the District of Columbia Circuit affirmed FERC’s 2005 ruling that the production costs of the five operating companies in the Entergy power system should be “roughly equalized” with the implementation of a +/- 11% bandwidth remedy each year....
