Judge Nixes Ortho-McNeil's Ultracet Patent

Law360 (April 18, 2008, 12:00 AM EDT) -- A federal judge tossed Ortho-McNeil Pharmaceutical Inc.'s infringement suit against Caraco Pharmaceutical Laboratories Ltd. on Thursday, ruling that the asserted patent claims over the painkiller Ultracet were invalid.

Judge Dennis M. Cavanaugh of the U.S. District Court for the District of New Jersey granted Caraco's motion for summary judgment, finding that the patent for Ultracet's combination of ingredients was obvious and significantly anticipated in prior art.
