Solicitor General Asked To Weigh In On Patent Case

Law360, New York (April 21, 2008, 12:00 AM EDT) -- The U.S. Supreme Court has invited the U.S. solicitor general to weigh in on a dispute over a state’s right to claim sovereign immunity in patent disputes.

The case before the high court is an appeal of an October decision by the U.S. Court of Appeals for the Federal Circuit, which affirmed a dismissal of a patent infringement suit brought by Biomedical Patent Management Corp. against California’s Department of Health Services.
