Tyson's 'No Antibiotics' Claims Untrue, Court Says

Law360 (April 23, 2008, 12:00 AM EDT) -- A federal judge has barred Tyson Foods, Inc. from touting its chicken as "Raised Without Antibiotics," issuing a preliminary injunction against the poultry giant after Perdue Farms Inc. and Sanderson Farms Inc. accused their rival of deceptive advertising.

Judge Richard D. Bennett of the U.S. District Court for the District of Maryland issued the injunction Tuesday after determining that Tyson's nonlabel advertisements swayed consumers away from competitors, luring them with the untrue claim that Tyson chicken was not treated with antibiotics.
