Hershey Targets Mars, Nestle Importer Over Candy IP
By Bill Donahue (May 28, 2014, 5:33 PM EDT) -- The Hershey Co. lodged a lawsuit Tuesday in California federal court against an importer that it claims is infringing its Reese's brand and other trademarks by importing various candies produced by Mars Inc. and Nestle SA from the British Isles.
Hershey says Posh Nosh Imports (USA) Inc., which specializes in U.K.-based brands, is infringing the famous orange Reese's trade dress by bringing Nestle's Toffee Crisp candy bars into the U.S. and infringing Hershey's York Peppermint Patty trademark by importing Nestle's Yorkie bars.
