Appellate Court Rejects Langone's Dismissal Bid

Law360, New York (April 25, 2008, 12:00 AM EDT) -- A New York state appellate court has refused to dismiss claims brought against Home Depot founder Kenneth Langone over his alleged breach of fiduciary duty while he served on the board of the New York Stock Exchange.

In a 3-2 decision Thursday, the First Judicial Department of the New York State Supreme Court’s Appellate Division affirmed a lower court’s August 2006 denial of Langone’s motion for summary judgment.
