Texas High Court Bars Refiling Of Wage Claims

Law360, New York (May 6, 2008, 12:00 AM EDT) -- Workers whose wage claims are dismissed by the Texas Workforce Commission are prohibited from taking their case to state court, the Texas Supreme Court has ruled, deciding the issue for the first time.

Delivering the 5-4 majority opinion of the state's highest court on Friday, Justice Dale Wainwright said final adjudication before the commission barred claimants from later suing employers for the same damages in a Texas court.
