Commission Orders France To Explain Role In Merger

Law360, New York (March 3, 2006, 12:00 AM EST) -- Investigating whether France illegally blocked an Italian utility company’s takeover bid, the European Commission ordered France to explain by March 17 the events that resulted in a merger between two French energy companies, Suez and Gaz de France.

In a memorandum sent by the Italian company, Enel, to the European Commission on Thursday, Italy alleged France instigated a €33.3 billion merger between Gaz de France and Suez in an economic protectionist attempt to foil a potential bid from Italian rival Enel.
