Law360, New York (May 7, 2008, 12:00 AM EDT) -- A former tax attorney for power company Dynegy Inc. who is appealing the six-year prison term he is currently serving for securities fraud has asked the judge overseeing his case to recuse himself, noting that the judge was friendly with a prosecutor who allegedly kept him from mounting a proper defense.
Jamie Olis, the defendant in the criminal case, contends that his conviction should be overturned because federal prosecutor Michael Shelby wrongly interfered with his defense. Shelby committed suicide in 2006.
