Court Lets EU Pursue Spain For E.ON Conditions

Law360, New York (May 7, 2008, 12:00 AM EDT) -- The European Union Court of First Instance has refused to grant Spain interim measures to preserve conditions the country had placed on a merger between German energy titan E.ON AG and Spanish Endesa SA, clearing the way for the European Commission to pursue Spain for interference.

In a ruling from late April that was made public on Wednesday, CFI President Marc Jaeger said that Spain had failed to show an urgent need for “interim measures” while its case was pending in front of the court....
