In Win For Axis, 8th Circ. Holds Drownings Were 1 Event

By Bibeka Shrestha (July 11, 2014, 4:12 PM EDT) -- The Eighth Circuit on Friday upheld a ruling that claims against a Christian sports camp over the drowning of two boys at a pool party involved one occurrence instead of two, limiting the obligations of Axis Insurance Co. over the protests of an umbrella insurer.

In a published decision, the federal appeals court agreed with a Missouri federal judge's holding that coverage under Axis' commercial general liability policy for the underlying litigation against the Fellowship of Christian Athletes was limited to $1 million, and that umbrella insurer Ironshore Specialty Insurance Co. must provide coverage above that amount.
