ITC Plays Bigger Role In Patent Litigation

Law360, New York (May 8, 2008, 12:00 AM EDT) -- The U.S. International Trade Commission is gaining a reputation for handing down timely and effective rulings — and emerging as a more popular forum to bring patent infringement disputes.

The independent federal agency, which has the power to bar imports of products that infringe U.S. patents, has already launched 31 Section 337 investigations so far this fiscal year (from Oct. 1 to Sept. 30).

The number of case reviews has nearly tripled since fiscal year 2000 and is on track to surpass the 31 investigations instituted...
