NLRB Lacked Authority Over DHL Pilots: 9th Circuit

Law360 (May 8, 2008, 12:00 AM EDT) -- An appeals court has set aside a National Labor Relations Board ruling against an airline pilots union accused of attempting to force DHL Holdings from doing business with ABX Air Inc.

The U.S. Court of Appeals for the Ninth Circuit ruled on Thursday that the NLRB lacked jurisdiction to rule on the matter against the Air Line Pilots Association because the dispute arose from the Railway Labor Act, not the National Labor Relations Act.

The railway act applies to railroad and airline employees.
