Wal-Mart's 'Express For Less' Slogan Riles Express

Law360, New York (May 15, 2008, 12:00 AM EDT) -- Retail clothing maker Express LLC has sued Wal-Mart for trademark infringement over Wal-Mart's ad campaign using the tagline “Express For Less.”

Express, which operates 620 stores in the U.S., filed the suit Monday in the Southern District of New York. It claims that the ads have the potential to mislead consumers into believing that Wal-Mart carries Express brand clothing.

Wal-Mart applied for a trademark on the “Express For Less” slogan in October, but Express only became aware of the application in April.
