Appeals Court Denies Full Pay For Emergency Services

Law360, New York (May 16, 2008, 12:00 AM EDT) -- An Illinois appellate court has affirmed the dismissal of a putative class action against managed care organizations that refused to fully pay for emergency medical services, ruling that a contrary decision would risk the “extinguishment” of such organizations.

The Appellate Court of Illinois found on Thursday that reimbursements made by Medicaid program administrators Harmony Health Plan of Illinois Inc. and Amerigroup Illinois Inc. to emergency medical service providers were in accordance with federal and state law as well as the parties' individual agreements as Medicaid providers....
