NJ Appeals Court Orders New Look At Axed Wind Farm Project
Law360, New York (August 18, 2014, 7:52 PM EDT) -- The New Jersey Appellate Division has ordered the state's utilities regulator to reconsider Fishermen's Energy's application to develop an offshore wind farm in light of a recent grant from the U.S. Department of Energy worth up to $46.7 million, the developer announced Monday.
The remand order, dated Aug. 8, also requires the New Jersey Board of Public Utilities to use Fishermen's proposed energy price of $199.17 megawatt hours versus a price of $263 MWH that the developer contends the regulator wrongly incorporated into its decision earlier this year to reject plans for the facility 2.8 miles from the coast of Atlantic...
