St. Vincent Claimants Push Malpractice Suits

Law360, New York (March 16, 2006, 12:00 AM EST) -- Medical malpractice claimants have asked a Manhattan bankruptcy court to lift an automatic litigation stay, as they continue in their attempts to recover an estimated $100 million from bankrupt Saint Vincent Catholic Medical Centers.

Numerous malpractice plaintiffs have lobbied U.S. Bankruptcy Court Judge Adlai S. Hardin, hoping to convince him that the petitions should not be grounded until after the New York healthcare provider exits Chapter 11.

Under the U.S. Bankruptcy Code, all actions against a company are frozen when it files for Chapter 11 protection...
