Court Chides Lender For Letters To FLSA Plaintiffs

Law360, New York (May 29, 2008, 12:00 AM EDT) -- A federal judge has rejected calls by employees of First Residential Mortgage Network Inc. to sanction the lender for contacting plaintiffs in their ongoing overtime dispute but has rebuked the defendants' counsel and ordered restrictions on further communications.

Judge John Heyburn II, presiding over the wage-and-hour battle in the U.S. District Court for the Western District of Kentucky, said that although direct contact between warring sides in litigation was not prohibited under the state's code of professional conduct, it was ill-considered in this case.
