Judge Nixes RICO Class Action Against Blue Cross

Law360, New York (May 30, 2008, 12:00 AM EDT) -- A putative class of non-MD medical professionals including chiropractors and podiatrists has been rebuffed in its suit accusing 23 Blue Cross and Blue Shield affiliates of systemically denying, delaying and diminishing payments, with a federal judge tossing its latest complaint and closing the case.

Judge Federico A. Moreno, who also presided over a similar class action brought by about 900,000 doctors, dismissed the plaintiffs' third amended complaint on May 23 in the U.S. District Court for the Southern District of Florida.
