Banks Eye Patents for Convertible Structures

Law360 (December 11, 2003, 12:00 AM EST) -- Several investment banks, including Banc of America Securities, Goldman Sachs and Merrill Lynch are seeking to patent new convertible structures, Dow Jones Newswires reported Friday, citing “sources familiar with the matter.”

However, attorneys interviewed by Dow Jones questioned whether patents on complex financial structured would hold up in court. In the case of the convertible structures, there may not be enough knowledge in the public domain to determine whether a financial engineering idea is non-obvious, they told the news service.
