Court Vindicates EC's Merger Review Procedure

Law360 (March 23, 2006, 12:00 AM EST) -- More than four years after a blocked merger embarrassed the European Commission, the European Court of Justice has partially vindicated the regulator in a lawsuit filed by French electrical equipment maker Schneider Electric SA.

Schneider Electric sued the Commission in March 2002, after former E.U. Competition Commissioner Mario Monti blocked the company’s €5 billion takeover of French rival Legrand SA in November 2001.

The botched merger would have created one of the largest electrical companies in the world and Schneider's suit seeks €1.66 billion in damages...
