AbbVie Can't Keep AndroGel Death Suit Out Of State Court
Law360, New York (October 1, 2014, 6:47 PM EDT) -- A California federal judge on Monday remanded a wrongful death suit against AbbVie Inc. over its AndroGel testosterone drug to state court, rejecting the pharmaceutical firm's bid to stay the suit while waiting for it to be transferred to the multidistrict litigation in Illinois over alleged injuries from testosterone treatments.
U.S. District Judge Josephine Staton granted a motion by plaintiff Evelyn Calvillo, whose husband allegedly died after using AndroGel, to remand her suit to the Orange County Superior Court, where she had filed it in July. Judge Staton rejected AbbVie's argument that Calvillo had included the California-based pharmaceutical distributor McKesson Corp....
