Law360, New York (October 3, 2014, 6:29 PM EDT) -- A proposed class action filed Friday in Florida federal court alleges bottled water company DS Services Inc. violates federal labor laws because it does not compensate its sales associates who work inside Costco Wholesale Corp. stores for overtime work.
The lawsuit, brought by lead plaintiff Craig Appleman, said DS Services sales employees regularly work more than 40 hours per week selling products inside Costco stores, but do not receive time-and-half overtime pay premiums for the additional hours they are required to work. Instead, DS Services supplements employee pay with bonuses and commission, according to the complaint.
