Merck Must Turn Over Docs In Fosamax MDL: Judge

Law360, New York (June 6, 2008, 12:00 AM EDT) -- The judge overseeing the multidistrict litigation over the osteoporosis drug Fosamax has ruled that Merck & Co. Inc. must divulge materials dating back to 1998, despite the company's stance against turning over certain pre-2003 materials.

Merck had objected to producing certain documents or information relating to Fosamax before September 2003, the date when it says a temporal association between osteonecrosis of the jaw and bisphonates was first reported in medical literature.
