High Court Refuses To Hear Donning, Doffing Cases

Law360, New York (June 9, 2008, 12:00 AM EDT) -- The U.S. Supreme Court has declined to weigh in on the so-called donning and doffing debate, leaving the increasingly contentious wage-and-hour issue unresolved by the nation's divided circuit courts.

Despite conflicting conclusions by the federal appeals courts on what constitutes compensable work, the high court on Monday declined to take any one of three cases seemingly suited to hear the arguments.

The justices refused a petition to hear an appeal filed in February by attorneys for Tyson Foods Inc., which faces more than 30 wage-and-hour lawsuits...
