Sunscreen Maker Will Redesign Trade Dress

Law360, New York (June 12, 2008, 12:00 AM EDT) -- Personal care products company Fruit of the Earth Inc., currently entangled in a trade dress dispute with Schering-Plough Corp., the maker of Coppertone sunscreen, announced it will soon change the package design of its generic sunscreens.

Adam Floyd, an attorney for Fruit of the Earth, said Thursday that the company plans to have the redesigned products available in two weeks or less. Exactly how the dispute arrived at this point is a matter of debate between the parties, however.
