Calif. County Fracking Bans Set Stage For Statewide Brawl
Law360, New York (November 7, 2014, 6:07 PM EST) -- Two California counties on Election Day joined a growing list of Golden State localities outlawing hydraulic fracturing, setting up a collision with statewide fracking regulations enacted last year that will spark court challenges from the oil and gas industry and landowners, experts say.
Voters in Mendocino and San Benito counties passed proposals outlawing fracking within their borders, while a third proposal in Santa Barbara County failed. The practical effects of the new bans are relatively minor, since Mendocino County has no oil or gas wells, while San Benito County had only 20 active wells in 2013, according to state records.
