CAFC Upholds Fees Award In Misconduct Ruling

Law360, New York (June 18, 2008, 12:00 AM EDT) -- Prospects dimmed Tuesday for Ole K. Nilssen when an appeals court affirmed a decision to grant millions of dollars in attorneys’ fees to Osram Sylvania Inc., after the inventor’s suit against the lighting manufacturer was tossed due to his inequitable conduct in securing and maintaining his patents for fluorescent lightbulbs and ballasts.

The U.S. Court of Appeals for the Federal Circuit determined that the district court was correct to award Osram approximately $6 million in attorneys’ fees and costs.
